states government. cnn has just learned the department of justice is suing armstrong. ed, bring us up to date on all this, this dates back to when lance was riding alongside floyd landis with the u.s. postal service team, and then he comes out with this confession, et cetera, and now this pursuit by the justice department. >> reporter: several years ago that former teammate, floyd landis, in a whistleblower lawsuit filed against lang armstrong and his sports teams and various associates, that was filed a couple of years ago. now lance armstrong's lawyers tell us they have been notified by the department of justice and told that the justice department is joining in on that lawsuit. this is interesting because about a year ago the justice department failed or decided not to pursue any criminal charges against lance armstrong, had given that up before the u.s. anti-doping agency put out its report which led to lance armstrong confessing in that televised interview back in january that, indeed, he had used performance enhancing drugs throughout his cycling career and winning those seven t

, will the super bowl of nascar racing, the daytona 500, even run tomorrow? but to start us off tonight, we have new incredible video of today's fiery crash. we take you right into the stands, in the middle of the chaos. watch. and here's how it all started. the multi-car smash-up happened seconds before the checkered flag at today's nationwide series race. the cars were packed tonight jostling for position racing at the top of their speed. they got tangled up. the collision sent kyle larson's 32 car hurtling toward the fence that's supposed to protect the fans. some crashing through and over that fence. 14 people were taken to hospitals. frantic repairs to the track are going on right now as we speak. we'll update you on this story throughout the hour tonight. nascar reacted immediately to the crash. i talked with driver brad keselowski just moments after it happened. at that point, he didn't know about the injuries. we now know 28 people were hurt, two critically. brad tells us what happens from a race car driver's perspective. >> i think you look at the wreck. there was a battle for the lead.

, more especially as we discussed today, being a person who has to use prosthesis and whilst ad nit knell has argued but why, in the same vain, would the accused get involved in a fight at melrose arch, or discharge a firearm under the table? i think what we are seeking to establish is the ends to which one would go to save himself, and in advocate knell's scenario i don't think that falls so much for consideration. the issue before me is whether this accused, being who he is, and with the assets that he has in the country would possibly want to seek to duck and dive all over the world when, even by the state's own concession, he may at worst case scenario face cull possibly whom tide. in as much as the minimum sentence legislation may be applicable there is a professionition for special circumstances or substantial and compelling circumstances which would cause the trial judge to deviate so it may not necessarily be the case that he is now committed to face 15 years imprisonment or life in prison. i cannot find that the accused or i cannot find that it has been established that the accus
